In the past, when someone left a job, their desk was cleared and their work account deactivated. Now, even after your physical self has moved on, your "digital ghost" remains trapped in your former workplace, working for the boss for free.

最近,一款叫作同事.skill的開源項(xiàng)目在GitHub上線并迅速走紅,只需導(dǎo)入同事的職場數(shù)據(jù)作為素材,就能通過AI生成可替代同事工作的AI技能。換言之,給AI智能體裝上這個(gè)技能,就能創(chuàng)造出跟同事?lián)碛邢嗤ぷ鬟壿嬎季S,乃至說話方式都相似的“數(shù)字同事”。

A project called colleague.skill was recently published on GitHub, and quickly went viral. It promises to convert workplace data into digital versions of employees capable of replacing them on the job. In other words, equipping an AI agent with this capability will make it possible to create a "digital colleague" that shares the work logic and mindset of the human coworker, and even speaks in a similar way.

After going viral, the project ignited discussions about job security, technological ethics, privacy and personality rights.

小紅書上,有網(wǎng)友曬出數(shù)字前同事的消息:“我是已離職員工XX的數(shù)字分身。你可以向我提問,我會(huì)根據(jù)我在職期間的相關(guān)記錄為你解答?!?/p>

On social media platform Xiaohongshu, one user posted greetings from a digital former colleague: "I'm the digital avatar of the former employee. You may ask me questions, and I will answer based on documents from my time working here."

另一位網(wǎng)友則表示公司讓員工用自己的技能訓(xùn)練AI。

In another post, a user made an unverified claim that their company asked them to train an AI model based on their skills.

法律專家提醒,這類做法風(fēng)險(xiǎn)極大。

Legal experts warn that such practices carry significant risks.

北京市盈科律師事務(wù)所律師孟澤東表示,未經(jīng)他人同意,就抓取其工作溝通記錄、郵件和文檔等行為屬于濫用個(gè)人信息

Meng Zedong, a lawyer at Yingke Law Firm in Beijing, said collecting an individual’s work records, emails and documents without consent constitutes an abuse of personal information.

他說:“一般如設(shè)計(jì)圖紙、技術(shù)方案以及在職期間為完成任務(wù)創(chuàng)作的職務(wù)作品等屬于公司的知識(shí)產(chǎn)權(quán),而邏輯思維、溝通習(xí)慣以及工作經(jīng)驗(yàn)等屬于員工的個(gè)人隱私。公司無權(quán)在員工不知情下,用其技能訓(xùn)練AI。”

"Intellectual property such as design drawings and technical plans created during employment belongs to the company," he said. "However, logical thinking, communication habits and work experience are part of personal privacy. Companies have no right to use such data to train AI without the individual's knowledge."

如果AI模型能識(shí)別出具體某個(gè)人,這同樣可能侵犯其人格權(quán)。“我國法律明確規(guī)定公民人格尊嚴(yán)不受侵犯,這種行為涉嫌侵害人格尊嚴(yán)且違背公序良俗?!彼f。

If an AI model can identify a specific person, it may also infringe on personality rights, he added. "Chinese law stipulates that personal dignity is inviolable. Such acts may violate that principle and contravene public order and good morals," he said.

中央財(cái)經(jīng)大學(xué)法學(xué)院教授王葉剛認(rèn)為,抓取個(gè)人的職場數(shù)據(jù)生成數(shù)字分身,可能構(gòu)成對(duì)個(gè)人相關(guān)民事權(quán)益的侵害。

Wang Yegang, a law professor at the Central University of Finance and Economics, said creating digital replicas using personal data could infringe multiple civil rights.

他說,如果數(shù)字人使用真人的名字、聲音、身份,可能會(huì)侵犯其人格權(quán)。如果該數(shù)字人發(fā)表不當(dāng)言論,造成被抓取個(gè)人信息的特定個(gè)人社會(huì)評(píng)價(jià)降低的,還構(gòu)成對(duì)其名譽(yù)權(quán)的侵害。

If a replica uses a person's name, voice or identity, it may violate personality rights. If it makes inappropriate remarks that harm the individual’s reputation, it could constitute defamation, he said.

公司也無權(quán)要求員工用自己的技能訓(xùn)練AI,因?yàn)槠渫ǔ2⒉粯?gòu)成為人力資源管理所必需的情形。

He added that companies generally cannot require employees to train AI systems with their own skills, as this does not qualify as a necessary component of labor management.

“如果員工發(fā)現(xiàn)自己被復(fù)制,則個(gè)人有權(quán)依法請求行為人刪除數(shù)據(jù)、銷毀模型、賠禮道歉,并可以依法主張財(cái)產(chǎn)損害賠償和精神損害賠償?!?/strong>他說。

"Individuals who find themselves replicated have the right to request deletion of data, destruction of models and an apology," Wang said. "They may also seek compensation for property damage and emotional distress."

智聯(lián)招聘副總裁李強(qiáng)表示,企業(yè)嘗試這類工具的初衷,往往是為了把員工頭腦中的隱性經(jīng)驗(yàn)轉(zhuǎn)化為組織可以沉淀的顯性資產(chǎn),從而降低關(guān)鍵人才流動(dòng)可能帶來的業(yè)務(wù)斷層風(fēng)險(xiǎn)。他同時(shí)理解,這種做法也會(huì)讓在職員工產(chǎn)生一定的不安。

Li Qiang, vice-president of recruitment platform Zhaopin, said some companies are using such tools to transform employees' experience into organizational assets and reduce disruption when staff members leave. He understands that such practices may cause unease among employees.

在他看來,短期內(nèi)“同事.skill”并不會(huì)直接導(dǎo)致裁員。因?yàn)槟壳巴ㄟ^數(shù)據(jù)蒸餾出來的AI只能處理高度結(jié)構(gòu)化的標(biāo)準(zhǔn)化任務(wù),而復(fù)雜判斷、人際協(xié)調(diào)、臨場應(yīng)變等場景,還遠(yuǎn)遠(yuǎn)替代不了人的作用。

Li said the technology is unlikely to trigger layoffs in the short term, as AI models derived from employee data can only handle structured, routine tasks and cannot replace humans in complex decision-making, interpersonal coordination, or problem solving.

李強(qiáng)也提醒,如果企業(yè)過度依賴這種“蒸餾”出的技能包,反而可能削弱團(tuán)隊(duì)的創(chuàng)新活力。“AI擅長復(fù)刻過去的經(jīng)驗(yàn),但面對(duì)從未見過的新問題,仍然需要人的判斷和突破?!?/strong>

He cautioned, however, that over-reliance on such systems could weaken innovation. "AI is good at replicating past experience, but human judgment is still essential when confronting new problems," he said.

他最后談到,焦慮是正常的,但不必恐慌。每一次技術(shù)變革,其實(shí)都在重新定義“人的價(jià)值”。而這一次,AI反而幫我們看清了:哪些能力才是人類特有的。

Li added that anxiety is normal, but there is no need to panic. "Every technological revolution redefines human value," he said. "This time, AI may help us better understand which abilities are truly unique to human beings."
